NEW I-9 FORM DELAYED AGAIN UNTIL APRIL 3, 2009

USCIS announced on January 30, 2009 that the effective date of the new I-9 form and regulations have been delayed until April 3, 2009. The new I-9 form and regulations were originally scheduled to take effect February 2, 2009. The delay will provide USCIS additional time for further consideration of this rule.

As of April 3, 2009 the current I-9 Employment Verification form (revision date 06/05/2007) will no longer be authorized and a new I-9 form will be available for download from the USCIS site  www.uscis.gov.  Specifically, the new form requires that all documents presented for verification must be valid at the time of verification, thus expired U.S. passports are no longer acceptable.  Further, USCIS (legacy INS) documents and forms I-688, I-688A and I-688B are NO LONGER acceptable.  Unexpired Foreign passports with accompanying I-94 and a temporary I-551 stamp continue to be acceptable, in addition a temporary I-551 printed notation on a machine readable immigrant visa is now acceptable.
